LESCA LUNETIER does not sell prescription lenses. These Products are offered on the online store of LESCA LUNETIER SARL (hereinafter the "Site" and "LESCA LUNETIER").

These general terms and conditions of sale (hereinafter the "T&Cs") apply to all orders for Products placed on the Site by consumer customers (hereinafter the "Customers"). Any order implies acceptance of these T&Cs, which the Customer can consult, save and print before placing an order.

Article 1 – Customer account

The Customer may order as a guest or create a customer account ("My account") with a valid email address. The account makes it possible to track orders and view order history. The Customer may change their details at any time in "My account" or by writing to Customer Service at eshop@lescalunetier.com, and may delete their account at any time.

Article 2 – Orders for Products

2.1 – Placing an order

The Customer selects the desired Products and options (colour, type of lenses), then checks the delivery address, billing address, delivery method, quantities, price of the Products, delivery costs and order total. The Customer may correct these details at any time before confirming.

The order is definitively confirmed when the Customer confirms payment by clicking the confirmation button on the payment page. This confirmation constitutes acceptance of these T&Cs and an electronic signature serving as proof of the entire order. LESCA LUNETIER confirms the order by email.

LESCA LUNETIER reserves the right to refuse an order in the event of an existing dispute with the Customer or total or partial non-payment of a previous order. Once the order has been confirmed and paid, it can no longer be modified; for any request, the Customer may contact Customer Service on +33 (0)4 42 50 63 09 or at eshop@lescalunetier.com before shipment.

2.2 – Product availability

If a Product turns out to be unavailable after the order, the Customer is informed as soon as possible by email or telephone. The Customer may choose a replacement Product or the cancellation of the order; in that case, the Customer is refunded within fourteen (14) days at the latest.

Article 3 – Prices and payment

Article 6 – Guarantees

6.1 – Legal guarantees

All Products benefit from the legal guarantee of conformity (articles L.217-3 et seq. of the French Consumer Code) and the guarantee against hidden defects (articles 1641 to 1649 of the French Civil Code).

The consumer has two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity. During this period, the consumer only has to establish the existence of the lack of conformity and not the date on which it appeared. The legal guarantee of conformity obliges the professional to repair or replace the goods free of charge, within thirty days of the request and without major inconvenience to the consumer. The consumer may obtain a price reduction or terminate the contract and be refunded against return of the goods if the professional refuses to repair or replace the goods, if the repair or replacement does not take place within thirty days, if bringing the goods into conformity causes major inconvenience, or if the defect persists after an unsuccessful attempt to bring them into conformity; the consumer may also claim this without a prior attempt where the defect is so serious that it justifies an immediate price reduction or termination of the contract. The consumer may also withhold payment of all or part of the price until the professional has fulfilled its obligations. The legal guarantee of conformity applies without prejudice to the guarantee against hidden defects, which may be invoked within two years of discovery of the defect. A professional who obstructs in bad faith the implementation of the legal guarantee of conformity is liable to a civil fine of up to €300,000, which may be increased to 10% of average annual turnover (article L.241-5 of the French Consumer Code).

6.2 – LESCA commercial guarantee

In addition to the legal guarantees, which it does not replace, LESCA LUNETIER grants free of charge a one (1) year commercial guarantee from delivery, covering manufacturing defects of the frames (hinges, welds, acetate), excluding normal wear and tear, impacts, scratches and misuse. It applies whatever the country of delivery. To use it, the Customer contacts Customer Service at eshop@lescalunetier.com or on +33 (0)4 42 50 63 09, with proof of purchase and a photo of the defect; LESCA LUNETIER offers a repair or replacement.

Article 7 – Liability

LESCA LUNETIER is not liable for any failure or delay in performing its obligations resulting from force majeure within the meaning of article 1218 of the French Civil Code, or from the Customer's own conduct. This clause does not limit the rights the Customer holds under mandatory legal provisions, in particular the legal guarantees.

Article 8 – Intellectual property

All elements of the Site (texts, visuals, logo, designs) are protected by copyright, trademark law and design law, and are the exclusive property of LESCA LUNETIER. Any total or partial reproduction without written authorisation is prohibited.

Article 9 – Personal data

LESCA LUNETIER processes the Customer's personal data in compliance with the GDPR (EU Regulation 2016/679) and French law no. 78-17 of 6 January 1978. To find out more and exercise their rights, the Customer may consult the privacy policy.

Article 10 – Amendment of the T&Cs

LESCA LUNETIER may amend these T&Cs at any time. The applicable T&Cs are those in force on the date the order is confirmed.

Article 11 – Applicable law, disputes and mediation

These T&Cs are governed by French law. In the event of a dispute, the Customer first contacts Customer Service (eshop@lescalunetier.com) in order to seek an amicable solution. In accordance with articles L.612-1 et seq. of the French Consumer Code, the Customer may use the consumer mediator free of charge: CM2C — 49, rue de Ponthieu, 75008 Paris, France — Tel.: +33 1 89 47 00 14 — www.cm2c.net — cm2c@cm2c.net. Failing agreement, the dispute falls within the jurisdiction of the competent courts; the consumer may bring the matter, at their choice, before the court of the place where they resided at the time the contract was concluded or the harmful event occurred.
